Terms and Conditions

 

YOUR CONTRACT IS WITH CherryYoga.co.uk

1. BOOKING PROCEDURE

(a) On making a booking with us, each person attending must accept the terms of these Booking Conditions.

​

(b) Payment of a non-refundable deposit (amount varies according to specific retreat) will confirm your place.
Where a deposit has been paid to ensure a day retreat  early bird special price, a final request will be sent to you approximately 1 week before the early bird deadline for full payment to be made showing the date for payment of the balance of the price of the retreat. If the balance of the early bird price for your retreat is not paid on time, we reserve the right to increase the price to the full non discounted rate. For one week retreats the deposit will be followed by a payment plan.

Full price bookings require full payment to be made 4 or 5  weeks prior to retreat start date or immediately if booking is last minute. If the outstanding payment is not received 4 weeks before the retreat dates we retain your deposit and apply the Cancellation Charge set out in Paragraph 4.

(c) For bookings made within 6 weeks of the date of departure, the full payment will become due immediately upon confirmation of the booking. Once payment has been made any subsequent cancellation will incur Cancellation Charges as set out in paragraph 4.

(d) Your booking is considered definite and a contract will exist between you and Cherry Yoga only when an email of confirmation has been sent to you. No contract will exist between us prior to our issuing the confirmation email.

(e) We reserve the right to increase the prices published prior to the time that you book your holiday. Any increase in price will be advised to you before you book the holiday.

​

2. SURCHARGES

We reserve the right to increase the price of your transfer arrangements to allow for variations in transportation costs due, taxis or fees chargeable for services and the exchange rate applicable to your travel arrangements. No price increase will be made within 30 days of your departure date and in any event, we will absorb any increase which equals 5% or less of the cost of your travel arrangements.

3. Holiday/Retreat PRICES

Our holiday prices include accommodation, all meals as stipulated, excursions, treatments as advertised and all group yoga and meditation classes, unless stated differently in your booking confirmation email.
Our prices exclude flights, travel insurance, tips, additional excursions, transfers from airports and train stations unless otherwise stated or arranged.

4. CANCELLATION BY YOU

You (or any member of your party) may cancel your holiday/retreat at any time providing that the cancellation is made by the person submitting the booking form and is communicated to us in writing. Cancellation will take effect the day such notification is received by us. As this incurs administrative costs, we will retain your deposit and, in addition, may apply cancellation charges up to the maximum shown below:-

7. CANCELLATION BY US

Cherry Yoga reserves the right in any circumstances to cancel your holiday at any time up to 10 weeks before the start date, in which case we will offer a full refund. Cherry Yoga will not be responsible for any monies you have paid for travel or any other expenses, so please make sure you have adequate cancellation insurance in place.

Important Notes

(a) Compensation payments will not apply if payment for your holiday has not been received by Cherry Yoga by the stipulated payment date.

(b) Compensation will not be paid if Cherry Yoga is forced to cancel or in any way change your holiday due to war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, technical or maintenance problems with transport, or other circumstances which amount to force majeure.

(c)Covid 19 policy: in the event that a retreat has to be cancelled/post-poned due to Covid19 or another similar pandemic , Cherry Yoga will endeavour to provide a full refund or a place at a rescheduled event if applicable, in some cases this may not be possible due to suppliers charges and a smaller or no refund may apply

8. FLIGHTS

We do not book flights for our clients. We may recommend suitable flights, trains and provide directions but Cherry Yoga is not responsible for your travel plans and arrangements. It is your responsibility to confirm your flight times and check in with your airline before your outward and return journey.

9. OUR LIABILITY TO YOU

(a) We accept responsibility for ensuring that the Retreats/holidays that you book with us are supplied as described and that the services we are contractually obliged to provide are to a reasonable standard.

(b) Optional trips booked locally are not our responsibility. However please note the following: -

There are risks inherent with any activity holiday and with physical exercise such as yoga. We strongly recommend that you consult your doctor before travel to advise on your ability to undertake strenuous exercise. You should make him/her and us aware of any medical condition which may affect your ability and comfort when undergoing vigorous exercise.

We ask that you complete our health-check form and let us know if you have a particular pre-existing injury or medical condition when you book so that we can make sure you will be able to fully enjoy your yoga break.

10. COMPLAINTS

If you have a problem during your holiday, please inform a member of our team immediately, who will endeavor to put things right. If your complaint cannot be resolved locally, you must advise us in writing on your return.

 

11. LOCAL CUSTOMS

Please familiarize yourself with the local customs of the country you are visiting, especially if it is a country with conservative culture or you are visiting an "off the beaten track" location. Clients who are deemed to be acting in a way that is inappropriate in the local environment or towards our local teams or other group members may be asked to leave. No refund will be given in this circumstance.

12. PASSPORTS, VISAS AND HEALTH REQUIREMENTS

You are responsible for ensuring that you have a valid passport and any necessary visas and any necessary or required inoculations or other health requirements.

 

13. THE CONTRACT

This contract is made on the terms of these Booking Conditions, which are governed by English law and the exclusive jurisdiction of the English Courts.
